This paper argues that the agency/structure dichotomy thatpredominates in racism discourse is problematic because itobscures how racism is produced and resisted at the local sitesof relations between individuals and between individualsand institutions. Racism permeates social relations,ensured by `knowledge' and guaranteed through self-regulation. Resistance to racism requires arecognition of racism's `local' character. As aresult, educators, particularly in classrooms,play important roles in resistance-practices.

No consensus yet exists on how to handle incidental fnd-ings in human subjects research. Yet empirical studies document IFs in a wide range of research studies, where IFs are fndings beyond the aims of the study that are of potential health or reproductive importance to the individual research participant. This paper reports recommendations of a two-year project group funded by NIH to study how to manage IFs in genetic and genomic research, as well as imaging research. We conclude that researchers (...) have an obligation to address the possibility of discovering IFs in their protocol and communications with the IRB, and in their consent forms and communications with research participants. Researchers should establish a pathway for handling IFs and communicate that to the IRB and research participants. We recommend a pathway and categorize IFs into those that must be disclosed to research participants, those that may be disclosed, and those that should not be disclosed. (shrink)

Genomic research results and incidental findings with health implications for a research participant are of potential interest not only to the participant, but also to the participant's family. Yet investigators lack guidance on return of results to relatives, including after the participant's death. In this paper, a national working group offers consensus analysis and recommendations, including an ethical framework to guide investigators in managing this challenging issue, before and after the participant's death.

Exploring the Illusion of Free Will and Moral Responsibility is an edited collection of new essays by an internationally recognized line-up of contributors. It is aimed at readers who wish to explore the philosophical and scientific arguments for free will skepticism and their implications.

This paper evaluates and critiques a recent restructuring initiative for a college at a Midwestern university in the United States in which three academic departments were reduced down to two departments. The case study presents the experiences and perspectives of three faculty members– one from each of those departments–who participated in the restructuring process. The paper first introduces the current challenges and complexities in Institutions of Higher Education (IHEs) which initiate and influence restructuring efforts After laying out the context of (...) our case study, we examine faculty perceptions of the purpose, the plan, and the process of restructuring through an interpretive phenomenological case study analysis using Putnam and Nicotera’s ( 2009 ) Communicative Constitution of Organization (CCO) as a theoretical framework. The findings are presented as three integrated themes including the importance of a clear and purposeful rationale, maintenance of consistent communication and organization, and an ethical commitment to faculty voice and choice. The ethical implications for each theme are discussed and recommendations for restructuring initiatives are offered. The results of this study will help inform restructuring initiatives in colleges and universities with a particular emphasis on characteristics of effective, ethical leadership and the value of strong communicative elements when engaging in restructuring. This article contends that the paradigm of individual health, focused on a right to individual medical care, is incapable of responding to health inequities in a globalized world and thereby hampers efforts to operationalize health rights through public health systems. While the right to health has evolved in international discourse over time, this evolution of the individual right to health cannot address the harmful societal ramifications of economic globalization. Rather than relying solely upon an individual right to medical care, envisioning a collective right to public health – a right applied at the societal level to address underlying determinants of health – would alleviate many of the injurious health inequities of globalization. Returning genomic research results to family members raises complex questions. Genomic research on life-limiting conditions such as cancer, and research involving storage and reanalysis of data and specimens long into the future, makes these questions pressing. This author group, funded by an NIH grant, published consensus recommendations presenting a framework. This follow-up paper offers concrete guidance and tools for implementation. The group collected and analyzed relevant documents and guidance, including tools from the Clinical Sequencing Exploratory Research Consortium. The authors then (...) negotiated a consensus toolkit of processes and documents. That toolkit offers sample consent and notification documents plus decision flow-charts to address return of results to family of living and deceased participants, in adult and pediatric research. Broadening access to both computational and educational resources is crit- ical to diffusing machine learning (ML) innovation. However, today, most ML resources and experts are siloed in a few countries and organizations. In this article, we describe our pedagogical approach to increasing access to applied ML through a massive open online course (MOOC) on Tiny Machine Learning (TinyML). We suggest that TinyML, applied ML on resource-constrained embedded devices, is an attractive means to widen access because TinyML leverages low-cost and globally (...) accessible hardware and encourages the development of complete, self-contained applications, from data collection to deployment. To this end, a collaboration between academia and industry produced a four part MOOC that provides application-oriented instruction on how to develop solutions using TinyML. The series is openly available on the edX MOOC platform, has no prerequisites beyond basic programming, and is designed for global learners from a variety of backgrounds. It introduces real-world applications, ML algorithms, data-set engineering, and the ethi- cal considerations of these technologies through hands-on programming and deployment of TinyML applications in both the cloud and on their own microcontrollers. To facili- tate continued learning, community building, and collaboration beyond the courses, we launched a standalone website, a forum, a chat, and an optional course-project com- petition. We also open-sourced the course materials, hoping they will inspire the next generation of ML practitioners and educators and further broaden access to cutting-edge ML technologies. (shrink)

The active debate about the return of incidental or secondary findings in research has primarily focused on return to research participants, or in some cases, family members. Particular attention has been paid to return of genomic findings. Yet, research may generate other types of findings that warrant consideration for return, including findings related to the pathology of donated biospecimens. In the case of deceased biospecimen donors who are also organ and/or tissue transplant donors, pathology incidental findings may be relevant not (...) to family members, but to potential organ or tissue transplant recipients. This paper will describe the ethical implications of pathology incidental findings in the Genotype-Tissue Expression project, the process for developing a consensus approach as to if/when such findings should be returned, possible implications for other research projects collecting postmortem tissues and how the scenario encountered in GTEx fits into the larger return of results/incidental findings debate. ABSTRACT The welcome expansion of kairos beyond its traditional locus in public debate to a broad range of discourse forms and persuasive actions has not been matched by a reevaluation of the temporal logic of kairos, which is still seen as located in teleologic time. This article suggests that Walter Benjamin’s understanding of time could refigure kairos as a nonteleological relationship among past, present, and future. Benjamin provides a theoretical rationale for kairotic action that is distributed in time (...) and space and accounts for kairos of objects, places, technologies, and works of art. These temporal affordances, usually developed separately in contemporary theory, are deeply connected in Benjamin’s writing; his understanding of time therefore integrates currently unconnected lines of research and supports a fluid but coherent understanding of kairotic agency. The original data reported by Benjamin Libet and colleagues are reinterpreted, taking into account the facilitation which is experimentally demonstrated in the first of their series of articles. It is shown that the original data equally well or better support a quite different set of conclusions from those drawn by Libet. The new conclusions are that it takes only 80 ms for stimuli to come to consciousness and that “subjective back-referral of sensations in time” to the time of the (...) stimulus does not occur. This essay explores notions of maternal desire within feminist psychoanalysis with an interest in challenging heteronormative frameworks of analysis. Providing close critical readings of texts by Jessica Benjamin, Julia Kristeva, Kaja Silverman and Hortense Spillers, I trace conceptual openings through which to interpret maternal sexuality as a mobile process of intersubjectivity that is grounded in changing historical relations of experience. I argue that Spillers’ approach transforms a critical process of reading desire away from the insularities and exclusions of conventional (...) psychoanalytic knowledges towards a democratic and reflexive process of representation and analysis. Of the generation of post-1960s artists who looked to photography for a new set of conceptual tools, Gerhard Richter stands apart because he has uniquely professed a desire to “use painting as a means to photography,” that is, to bring painting to the structure and sensibility of the photograph.2 To ascribe sensibility or perceptive acuity to a process so mechanical as photography may strike the reader as either romantically fey or even offensively anthropomorphizing, given that the aesthetic questions at stake (...) have exactly to do with philosophy's “mind-independent” designation of the medium. But the metaphor has pedigree among historians of photography, having been articulated by Walter Benjamin in his “Little History of Photography,” where he characterizes photography as a medium possessed of an “optical unconscious,” a nature specifically “other” in its ability to present the “spark of contingency, of the here and now, with which reality has seared the subject.”3 It is precisely on the basis of this picture making outside of human agency, Benjamin insists, that “the dubious project of authenticating photography in terms of painting” fails, for it is an attempt to “legitimize the photographer before the very tribunal he was in the process of overturning.”4 Certainly, it is from this premise of photography's revolutionary capacity that the first critical assessments of the work of “artists using photography” proceeded in the 1970s and continued through the 1980s into the present decade.5 This is particularly important to keep in mind when assessing what has been called the recent turn to the pictorial in photographic practices because this move has been accompanied by, on one hand, a general pulling away from easily legible, unambivalent documentary content in photographic practices—a tendency that may itself be considered part of a quietly growing, renewed interest in the critical capacity of painting among a new generation of artists—and, on the other, a nuanced exploration of the appropriative lessons of postmodernism, manifested in recent interest in the repurposing of found, or what Benjamin might call “other-determined,” imagery.6. In this study of Giorgio Agamben's pre-Homo Sacer work, I assess his idea of the ethical subject. Over the course of these early writings, he adopts a Walter Benjamin-inspired redemptive aim as he endeavours to uncover the circumstances of alienated subjectivity and possibility of authentic experience. However, while Agamben borrows from Benjamin to elaborate on the ethical potential of the nihilist pose, a more Kantian conception of idealist autonomy becomes increasingly pronounced. Neuroscientist Benjamin Libet of the University of California in San Francisco asked volunteers to do exactly that. A clock allowed the subjects to note exactly when they decided to act, and by fitting electrodes to their wrists, Libet could time the start of the action. More electrodes on their scalps recorded a particular brain wave pattern called the readiness potential, which occurs just before any complex action and is associated with the brain planning its next move.

In this “Reply” paper, the arguments and experimental findings by Pockett, Pollen, and Haggard et al. are analyzed. It had been shown that a 0.5 s duration of repetitive activations of sensory cortex is required to produce a threshold of sensation. The view that this is due to a facilitatory buildup in excitatory state to finally elicit neuronal firing is shown to be incompatible with several lines of evidence. Objections to the phenomenon of subjective referral backwards in time are also (...) untenable. Haggard, Cartledge, Dafydd, and Oakley report that a self-initiated act can, under hypnotic suggestion, appear to the subject to be “involuntary.” The act under hypnosis is better viewed as one initiated unconsciously, not as an act of conscious will. I believe it was Alfred Kazin who (I've heard) said that the movements of today make the dissertations of tomorrow. Since that is always a difficulty, I am sure that my experience is not singular. Unfortunately, in my view, the decontextualization of Audre Lorde's speech at that conference can serve to perpetuate the misunderstanding that underlay the destructive polarization that occurred at that time. To accept her view that the event was organized with no effort to include women of color by oblivious, racist white women is surely not what happened. In fact, the estrangement between white and black women at the time of the "Second Sex Conference" had much deeper causes (the enduring structures of racism in our country) for which I believe no individual could be held responsible.First, let me clarify an important fact. While we organizers of the conference invited numerous black and third world women to participate, we were consistently declined. For instance, Mary Helen Washington said she did not want to speak to an audience of only white women, and it was her experience that only white women came to feminist conferences. Indeed, at the time Michele Wallace, who probably would have been interested had she been available, was vociferously complaining about the lack of interest, indeed the rejection of feminism, among black women. Audre Lorde herself, one of our consultants, had been apprised of the participants for months and never named anyone who could participate. Similarly, Robin [End Page 286] Morgan had been consulted and had offered no suggestions of black participants. Yet ten days before the conference her young black protégé at Ms., Susan McHenry, appeared with a series of demands, including a list of black women she wished to see invited to the conference. Although I had met with Robin Morgan months before, she had never told me of Susan McHenry or proposed her as a participant, rather her interest had been focused on what would become the anti-pornography movement, similar to the interests of Kathy Barry who wrote about female sexual slaves. At the conference, Susan McHenry did speak; she expressed her indignation and outrage, and suggested that the entire conference was a racist gathering that should change direction and consider only the issue of racial exclusion.It is certainly true that the organizers were distressed by the same issue prior to the conference. After nearly a year of organizing, soliciting, and publishing open calls for participation, we were absolutely desperate to find participants who would reflect racial and ethnic groups other than white middle class. The issue takes on special urgency in the United States, where sovereign right has been proclaimed persistently by the president in an attempt to justify policies of military aggression and violations of international and domestic law, executing these policies with disregard for traditional (...) judicial and constitutional procedures.1 Giorgio Agamben’s recently translated book State of Exception has touched off a small case of collective hysteria among American academics by claiming that by their intrinsic nature, democracies undermine themselves, that dictatorship is an ontological necessity of modern politics, and that the sovereign’s power to declare a state of emergency and with it a state exception to the law places potentially the whole world under the sign of the concentration camp.Agamben’s revelation, however, is not the scandal. It is a logical truism that something cannot be a member of its own set, that constituting power (pouvoir constituens) cannot be synonymous with constituted power (pouvoir constituent).Plato in the Timaeus described a self-eating, circular being as the first living thing in the universe–an immortal, perfectly constructed animal [image 1]. Agamben seems shocked to find that such an animal does not exist. If democracies could be self-constituting and self-reproducing, if they could realize the perfect closure of the Oroborus (snake consuming its tail), there would be no decay and no history—but also no hope, no escape from the magic circle of power that is capable of mystifying any political regime, no matter how democratically conceived.
